4.2.5. Friendly Captcha (bot and spam protection)

Our website uses the "Friendly Captcha" service provided by Friendly Captcha GmbH, Am Anger 3-5, 82237 Wörthsee, Germany (www.friendlycaptcha.com).

Friendly Captcha is an innovative, data protection-friendly protection solution to make it more difficult for automated programs and scripts (so-called "bots") to use our website. Friendly Captcha protects our website from misuse. We have integrated a program code from Friendly Captcha in certain areas of our website (e.g. in a contact form). This leads to the visitor's terminal device establishing a connection to the Friendly Captcha servers in the context of the protected area (e.g. sending a contact form). The visitor's browser receives a calculation task from Friendly Captcha. The complexity of the

calculation task depends on various risk factors. The visitor's terminal device solves the calculation task, which utilises certain system resources, and sends the calculation result to our web server. This contacts the Friendly Captcha server via an interface and receives a response as to whether the puzzle has been solved correctly by the terminal device.

In addition, the visitor's browser transmits connection data, environment data, interaction data and functional data to Friendly Captcha. Friendly Captcha analyses this data and determines how likely it is that it is a human user or bot and sends us the result.

Depending on this, we may treat access to our website or individual functions as human or potentially machine-based.

All of the above data is used exclusively for the detection and treatment of potential bots and risks as described above. The legal basis for this processing is therefore our legitimate interest in accordance with Art. 6 para. 1 letter f GDPR and serves to prevent potentially fraudulent activities on our website.

4.2.6 Algolia search

Our website uses the "Algolia Search" service provided by Algolia SAS, 55 Rue d'Amsterdam, 75008 Paris, France (https://www.algolia.com).

It is a real-time search tool that provides website users with direct feedback on their input. For this service to work, the search queries you enter in the web browser are processed. To use the Algolia search, it is necessary to temporarily save your IP address and the search query entered.

By using Algolia, your IP address and your search query are transmitted to an Algolia server and stored there for 90 days for statistical purposes. The storage location of the data is in the EEA.

The use of the Algolia search serves to improve the accessibility and findability of our online offer. Use is voluntary and involves the entering of a search query. The legal basis for this processing is therefore our legitimate interest pursuant to Art. 6 para. 1 letter f GDPR

4.2.7 Sentry

We use the Sentry service provided by Functional Software, Inc., 45 Fremont Street, 8th Floor, San Francisco, CA 94105, USA, on our website to detect and fix technical errors and performance issues.

Sentry offers the option of storing all data exclusively within the European Union. If this option is activated and all data traffic remains within the EU, no data will be transferred to a third country within the meaning of the General Data Protection Regulation (GDPR). In this case, no transfer impact assessment is required.

Should access from the USA occur in individual cases, for example in the context of support, it should be noted that Sentry is certified under the EU-U.S. Data Privacy Framework. This certification is recognised by the European Commission as an adequate basis for data transfers to third countries in accordance with Art. 45 GDPR.

A contract for order processing in accordance with Art. 28 GDPR has been concluded with Sentry, which meets the requirements of data protection law. This ensures that only personal data necessary for error monitoring and, as far as possible, pseudonymised personal data is processed.

The data processed may include technical information such as IP address, browser type, operating system and error messages. The data is processed on the basis of our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR in order to ensure the technical functionality and security of our website. 4.2.8 AWS SES

We use the Amazon Simple Email Service (SES) provided by Amazon Web Services EMEA SARL, 38 avenue John F. Kennedy, L-1855 Luxembourg, to send transactional emails (e.g. confirmations, system notifications).

The use of AWS SES is based on our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR in order to ensure the reliable and secure delivery of our emails.

When using AWS SES, personal data (such as email addresses) may be transferred to servers within the European Union.

Data transfers to third countries outside the EU, for example to the USA, cannot be ruled out. In such cases, we ensure that an adequate level of data protection is guaranteed by concluding standard contractual clauses.

4.2.9 Cloudflare Inc.

Frauscher uses the services of Cloudflare (Cloudflare Inc., 101 Townsend St, San Francisco, CA 94107, USA) for individual offers, where transferred data can be processed, modified and forwarded by Cloudflare's servers. This allows Cloudflare to access personal data, in particular IP addresses, timestamps, system configuration and similar data that is essential for the provision of the service. Cloudflare uses this data to detect and defend against attacks and to improve the performance and stability of the services provided.

Cloudflare transfers data to the United States. The transfer is based on the EU-U.S. Data Privacy Framework (DPF) in accordance with Art. 45 GDPR. Cloudflare is certified under the Data Privacy Framework, which ensures an adequate level of data protection.

The use of Cloudflare is based on our legitimate interest pursuant to Art. 6(1)(f) GDPR in providing Frauscher's services securely, stably, and efficiently.

4.2.10 snapAddy

We use services provided by snapAddy GmbH for the collection and processing of contact data, as well as for the optimization of our sales and CRM processes. In this context, personal data such as name, email address, phone number, and company data may be processed.

The processing is carried out on the basis of Art. 6(1)(a) GDPR (consent) and/or Art. 6(1)(f) GDPR (legitimate interest).

4.2.11 pixx.io

We use the pixx.io digital asset management system to manage and make available digital media assets (images, videos, documents). The provider is pixx.io GmbH, Richard-Wagner-Straße 14c, 8453 Mühldorf am Inn.

In connection with the provision of the service, pixx.io processes server and access log data for technical and operational purposes. Such data may include, e.g., the IP address, the date and time of access, the requested URL, and technical information relating to the request.

Processing is carried out on the basis of Article 6(1)(f) of the GDPR (legitimate interests, operation, security) for the purposes of efficient administration, protection against misuse and attacks, and the secure and stable operation of digital business resources.

For the electronic dispatch of information on products and services, news, information about the company, invitations to trade fairs or events by e-mail, the customer magazine or the white paper (hereinafter “information on products and services”), we ask interested parties for their express consent to this Privacy Policy.

We use the so-called double opt-in process. There are various contact forms available on our website which can be used to get into contact electronically, for downloading documents, such as the white paper, or to order documents by e-mail, such as the customer magazine. If a user uses a contact form, the data given in the user interface is transmitted to us and stored electronically. The transmission of this data is done in an encrypted form. The respective data can be seen directly in the user interface.

Prior to the processing of data, your consent is always obtained and reference is made to this Privacy Policy. Alternatively, you can contact us through the contact form or the e-mail addresses provided on our website. In this case the user's personal data transmitted by e-mail will be stored. The data is used exclusively for processing the request.

The processing of the personal data from the user interface serves us only to process your contact request. In cooperation with business partners (such as customers and suppliers) we process your personal data for the following purposes:

• Communicating with business partners about products, services, and projects, for example to process inquiries from the business partner;

• Settlement of litigation, enforcement of existing contracts and assertion, exercise and defense of legal claims.

For the above purposes, we may process the following categories of personal information:

• Payment information, such as information required to process payment transactions or fraud prevention, including credit card information and card verification numbers;

• Information collected from publicly available sources, information databases or credit bureaus; and

• Other personal data whose processing is necessary for the initiation, processing, and management of ((pre-) contractual) business relationships and the maintenance of business relationships or which are voluntarily provided by you, such as orders placed, order details, requests made or project details, correspondence or other cooperation data;

The processing of personal data is necessary to achieve the above-mentioned purposes, including the performance of a contractual relationship or a pre-contractual activity with the business partner. The legal basis for the processing of this data is point (b) of Article 6(1) GDPR, because this data is needed so that we can fulfill our (pre-) contractual obligations to you.

If the personal data are not provided or not available to the required extent or if we cannot collect these, the individual described purposes may not be fulfilled or the request(s) may not be processed. Please note that this would not be considered a contractual default on our part.

The hosting services we use are for the purpose of providing the following services: infrastructure and platform services, computing capacity, storage and database services, security and technical maintenance services we use to operate this website.

In doing so, we or our hosting service provider processes inventory data, contact data, content data, contract data, usage data, metadata and communication data of customers, prospects and visitors to this website based on our legitimate interests in the efficient and secure provision of our website according to point (f) of Article 6(1) GDPR and Article 28 GDPR.

4.7.1. More Definitions Special Categories of Personal Data

Special Categories of Personal Data means Personal Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation.

We do not require any Special Categories of Personal Data from you for the application process.

4.7.2 Controller

Differently to the explanations given under point 3:

The controller (according to point 7 of Article 4 GDPR) of the application tool as well as the applicant management is Frauscher Sensortechnik GmbH and Frauscher Sensor Technology Group GmbH, Gewerbestraße 1, 4774 St. Marienkirchen, Austria.

The controller of your application is the company to which you have applied.

Frauscher Sensortechnik GmbH and Frauscher Sensor Technology GmbH are processors in this respect.

This Privacy Policy gives you information that applies to all data controllers within the European Union.

Inquiries and requests regarding your Personal Data will be processed by Frauscher Sensortechnik GmbH (see point 9).

4.7.3 Purpose of data processing

Differently to the explanations given under point 6:

The purpose of processing your data is to carry out the application process, to select applicants and to manage applicant profiles in our database.

If you do not provide us with your data, we will not be able to process your application.

4.7.4     Lawfulness of processing your data

We process your Personal Data:

• in order to take steps at the request of the data subject prior to entering into a contract (Art. 6 (1) lit. b GDPR),

• for the purposes of the legitimate interests (Art. 6 (1) lit. f GDPR),

• because you have given your consent to the processing (Art. 6 (1) lit. a GDPR) for storage, forwarding to other group companies and newsletter transmission.
   

4.7.5     Data we process

The individual types of data we process can be found in Appendix 1 of this Privacy Policy.

Note - Special Categories of Personal Data

We do not require any Special Categories of Personal Data from you for the application process and we therefore request that you do not provide us with any Special Categories of Personal Data. If the application documents you send us contain Special Categories of Personal Data, you explicitly consent to the processing (storage) of such Special Categories of Personal Data by us. You can revoke this consent at any time and without cause (see point 8).

4.7.6     Applicant profile

When you submit your application via our application tool, you create an applicant profile.

In your applicant profile, you can view and update your data at any time, change your privacy options and delete your profile. In addition through your applicant profile, you have access to the status of applications already submitted and you can withdraw applications.

4.7.7     Newsletter

Hear more about career opportunities:

You have the option to sign up for the "Hear more about career opportunities" newsletter. By clicking the checkbox, you agree to receive the job newsletter at the e-mail address you provided in the applicant profile. You can revoke this consent at any time and without giving reasons. This is possible by deactivating the newsletter subscription in your profile under "Search options and Privacy". We will process your data for the purpose of sending the newsletter until you revoke your consent. The revocation does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

Receive new job posting notifications:

Furthermore, you have the option to receive information about interesting jobs as well as career opportunities by e-mail via a search agent you have set up by clicking the checkbox at "Receive new job posting notifications". You can customise the settings for this search agent yourself in your profile, under Options - Job alerts. If you do not customise the settings in the search agent, your search entries will be used. By clicking the checkbox, you agree to receive new job postings to the e-mail address you specified in the applicant profile. You can revoke this consent at any time and without cause. This is possible by deactivating the registration in your profile under "Options - Job alerts". We will process your data for the purpose of sending you new job notifications until you revoke your consent. 4.7.8    Origin of the processed data

We collect the data listed in Appendix 1 as part of the application process either by you providing it to us (for example, by creating an applicant profile, applying for a position that is open) or by collecting it from you ourselves (for example, by taking notes during the interview).

4.7.9     Transfer of data

Differently to the explanations given under point 5:

In order to achieve the purposes indicated, we will disclose your data to the following recipients (processors). This disclosure may be made by transmission, dissemination or any other form of provision. We have entered into a Data Processing Agreement with the processors, which ensures that your Personal Data is handled in accordance with data protection requirements.

• Affiliated companies (§§ 15 cont. of the Austrian Stock Corporation Act), if you apply for employment with such a company or your consent has been obtained,

• IT service providers, such as

  • SAP Österreich GmbH , Lassallestraße 7b, 1021 Vienna, Austria, case-by-case transfer to a third country cannot be ruled out (Data Protection Agreement has been concluded, basis for transfer to a third country is Art. 49 (1) lit. b GDPR)

  • CodeSubmit LLC, Frans-Hals-Straße 3, 81479 Munich, Germany, a company that carries out technical assessments, data will only be transferred with the explicit consent of the applicant in accordance with Art. 6 (1) lit. a GDPR, the processing of personal data takes place exclusively in the European Union

Application data for a specific position:

We generally retain your data for the duration of the application process and for seven months after completion of this application process. After this period, your Personal Data will be deleted unless

• you have not consented to the storage of your data in a record database and/or

• there are no legal provisions that prevent deletion and/or

• no other legitimate interests of ours conflict with deletion.
   

Applicant profile data:

We generally retain your data in the application profile for 1 year from the date of your last activity in the profile. After this period has expired, your Personal Data will be deleted,

• unless the deletion period for the application data has not yet expired and/or

• unless you have consented to the transfer to a record database and/or

• unless deletion is prohibited by law and/or

• provided that no other legitimate interests of ours prevent deletion.
   

4.7.11  Cookies

When you use the application tool, cookies are stored on your terminal device. Cookies are small text files that are assigned to the browser you use and stored on your device, and that provide certain information to the entity that sets the cookie (by us or third parties). Cookies cannot run programs or transmit malware to your device. They serve to make the tool offer more user-friendly and effective overall.

In the cookie banner, you can set yourself which cookies are set. By activating the individual cookies in the banner, you simultaneously give your consent that we or third parties may set the respective cookies.

You can revoke this consent at any time and without cause by deactivating individual cookies in the cookie settings in the cookie banner. The revocation does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

In the application tool, in addition to the cookies of the website (see point 4.2), we use the cookies listed in Appendix 2.

4.7.12  Data processing upon conclusion of an employment contract

If we conclude an employment contract with you, the transmitted data will be stored and processed as employee data for the purpose of handling the employment relationship in compliance with the statutory provisions. This data processing follows its own privacy policy, which will be brought to your attention in this case.

1.1.1 The whistleblower system is designed to guarantee the highest possible level of data protection for whistleblowers. The whistleblower system can be used anonymously without providing personal data. This means that, when submitting a report, the anonymity of the whistleblower can be fully preserved.

1.1.2 To ensure the security of the data provided by the whistleblower, data transmission takes place exclusively using SSL encryption. We do not use any tracking tools or third-party cookies on the website.

1.1.3 The whistleblower system uses special encryption methods to ensure that only the respective whistleblower and our responsible Compliance Officers have access to the report provided. This means that the data contained in the report is only disclosed to the respective Compliance Officer within our Company; it is not disclosed to third parties in any other way (except for possible disclosure to competent authorities or courts, and/or to auditors for the further pursuit of the facts on which the report is based). In particular, our processors cannot access data within the report.

1.1.4 Depending on the information you provide to us, we process the following personal data:

• Identification data of the whistleblower and the accused person (e.g. name, personnel number)

• (Private) contact information of the whistleblower (e.g. address, e-mail address, telephone number)

2. Recipients fo your personal data

2.1  For the above purposes, we may disclose your personal data to the following recipients:

• For the technical hosting of the whistleblower system: RBS Responsible Business Solutions GmbH based in Vienna (no content data of the report is transmitted, only secondary technical data) as well as the technical sub-contractors A1 Telekom Austria AG and Wolf Rechtsanwälte GmbH & Co KG.

• Where disclosure is required (i) by law or regulation or (ii) for the establishment, exercise or defence of legal claims, we may also disclose personal data to competent authorities, such as supervisory, regulatory or criminal authorities, courts or other third parties advising us in this regard (e.g. lawyers, forensic experts or auditors).

2.2 Your data will only be processed within the EEA. Therefore, it will not be transferred to a third country.

3. Storage period of your data

3.1 Log files (see point 3.3 above) are generally retained for a period of three (3) months. Beyond this period, log files are only stored to investigate irregularities or security incidents in our systems. For the storage period of cookies, see point 3.5 above.

3.2 In general, we will only retain your personal data for as long as necessary to fulfil the purpose for which it was collected. Once a report has been verified, personal data contained therein will be deleted after the end of the legal retention period, unless investigations lead to disciplinary, legal or regulatory action.

3.3 Secondary technical data (IP address of the access to the whistleblower system) are processed exclusively inside the firewall of the processor and deleted after 24 hours.

We process your personal data for the provision and operation of the online platform "Frauscher Learning World" (hereinafter referred to as "Frauscher Learning World"). This is done exclusively for the intended purpose of providing further training, courses and information. If a user makes use of this option, the data entered in the input mask or automatically generated by the use of the website will be transmitted to us and stored.

Depending on the data you provide to us, we process the following personal data:

• Data entered during registration (e.g. name, email address, company name, company address, etc.)

• Data generated during authentication. The login with password and user name is used for authentication.

• Data generated when using the service (e.g. time of access to the course offering).  This data is recorded in a database and stored for as long as it is required for the use of Frauscher Learning World.

• Data generated by user activities within the Frauscher Learning World courses. The scope and type of data recorded depends on the design of the respective course offering. For example, the following data is logged: How and when set tasks are solved, learning content completed, knowledge and competence tests taken, posts in forums and participation in workshops. In the case of surveys that are not expressly labelled as "anonymous", the survey results can be attributed to the user.

The following personal data is absolutely necessary for the registration and use of Frauscher Learning World and is therefore marked as mandatory information: Name, e-mail address, password.

Data is transmitted exclusively using SSL encryption in order to guarantee the security of the data provided by the user.

The legal basis for the processing of personal data results from Art. 6 para. 1 letter b GDPR.

We only store your personal data for as long as is necessary to fulfil the purpose for which it was collected. As soon as the respective contract for the use of Frauscher Learning World ends, the relevant personal data will be deleted after the end of the statutory retention period.

During the operation of Frauscher Learning World, the responsible employees of Frauscher Sensortechnik GmbH, service providers and contractual partners are involved, who may receive your personal data. CLICK&LEARN GmbH, Petrinumstraße 12/3, 4040 Linz, Austria, as a service provider for the use of Frauscher Learning World, is also included in this and is involved through a data protection contract. Your data will be deleted or anonymised after the statutory retention period has expired.
