1 Preamble

The protection of your personal data is of particular interest for Frauscher Sensortechnik GmbH (hereinafter „we“, „us“) and all of its affiliates (hereinafter together „Frauscher“, „Frauscher Group“). We therefore collect, store and process your personal data in accordance with applicable data protection regulations, in particular, the European Union General Data Protection Regulation (hereinafter “GDPR”). This Privacy Policy provides information about which data we collect, what we use it for and which rights you have.

2 Personal data

„Personal data“ means any information relating to an identified or identifiable natural person (i.e. name, e-mail address, or IP address).

3 Controller

Controller (according to point 7 of Article 4 GDPR) of this website, for managing the data of our business partners as well as for applicant management is Frauscher Sensortechnik GmbH, Gewerbestrasse 1, 4774 St. Marienkirchen.

The storing entity of your personal data is in general Frauscher. We are entitled to assign external IT-service providers with the storage and processing of your personal data. In this case, we have concluded a data processing agreement with the service provider to ensure the privacy-compliant treatment of your personal data.

4 Data Collected

When visiting our website, we only collect the personal data that your browser automatically transmits to our server. We collect the data that is technically necessary for us to display our website and to ensure stability and security, especially the following:

  • IP-address
  • Date and time of the request
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of request (specific website)
  • Access status/HTTP-status code
  • Data volume transmitted
  • Website, from which the request comes from (referrer-URL)
  • Browser
  • Operating system and its interface
  • Language and version of your browser software
  • Your internet service provider.

 

The above-mentioned data is statistically evaluated with the purpose of furthering the enhancement of our Website's offerings and to make it more user-friendly, as well as to provide personalized and location-based content, to find and fix errors faster, and to control server capacityThis is also our legitimate interest according to point (f) of Article 6(1) GDPR.

If there is a concrete indication of illegal use of our website, we will use these data for the purpose of prosecution.

The IP addresses of users are deleted or made anonymous after a year in general. In the case of anonymization, the IP addresses are changed in such a way that individual details about personal or factual circumstances can no longer be assigned to a specific or identifiable natural person.

 

4.1.1 Google Maps

This website uses Google Maps API on some pages to visually display geographic information. When using Google Maps, Google Inc. ("Google") also collects, processes and uses data about the use of Google Maps features by visitors to our website. 4.2.3 Social Media

This website uses JENTIS®. The provider is JENTIS GmbH (Schönbrunner Straße 231, 1120 Vienna).

JENTIS ® is a tool that serves to analyse your user behaviour on our website. We use JENTIS® to better understand the needs of our users and to optimise the offer and experience on this website. This service provider, therefore, has access to web analytics data that is measured, stored and processed by the analytics tools in use and by JENTIS®.

Data is transmitted to JENTIS GmbH for the purpose of analysis, and JENTIS® also collects data on our behalf relating to the browser environment or the behaviour of the visitor. JENTIS GmbH only processes data that cannot be traced back to a person by JENTIS GmbH. IDs set by JENTIS® are merely random products and are used for anonymous recognition. For the electronic dispatch of information on products and services, news, information about the company, invitations to trade fairs or events by e-mail, the customer magazine or the white paper (hereinafter “information on products and services”), we ask interested parties for their express consent to this Privacy Policy.

We use the so-called double opt-in process. This means that after registering, we will send you an e-mail to the e-mail address provided at the time of registration, asking you to confirm that you wish to receive information on products and services by e-mail. If you do not confirm your registration within 72 hours, your information will be locked and automatically deleted after one month. We store your given personal data, the time of registration and of confirmation. The purpose of the process is to prove your registration and, if necessary, to clarify a possible misuse of your personal data.

After your confirmation, we will store your e-mail address for the purpose of providing you with information on products and services. The legal basis for sending the newsletter is your consent in accordance with point (a) of Article 6(1) GDPR. The legal basis for logging the application is our legitimate interest in accordance with point (f) of Article 6(1) GDPR to prove that the dispatch was made with your consent.

You can withdraw or object your consent to the dispatch of information on products and services at any time. You can withdraw or object your consent by clicking on the link provided in each e-mail or by sending a message to the contact details stated in the imprint.

There are various contact forms available on our website which can be used to get into contact electronically, for downloading documents, such as the white paper, or to order documents by e-mail, such as the customer magazine. If a user uses a contact form, the data given in the user interface is transmitted to us and stored electronically. The transmission of this data is done in an encrypted form. The respective data can be seen directly in the user interface.

Prior to the processing of data, your consent is always obtained and reference is made to this Privacy Policy. Alternatively, you can contact us through the contact form or the e-mail addresses provided on our website. In this case the user's personal data transmitted by e-mail will be stored. The data is used exclusively for processing the request.

The processing of the personal data from the user interface serves us only to process your contact request. In the case of contact via e-mail, this also includes our required legitimate interest in the processing of the data. The other personal data processed during the sending process serve to prevent misuse of the contact form and to ensure the security of our information technology systems.

If the data processing takes place to carry out pre-contractual measures, which occurs upon your request, or if you are already our customer, the data processing takes place for the execution of the contract, the legal basis for this data processing is point (b) of Article 6(1) GDPR. We process further personal data only if you consent to it (point (a) of Article 6(1) GDPR) or if we have a legitimate interest in the processing of your data (point (f) of Article 6(1) GDPR). Replying to your e-mail is such a legitimate interest.

In cooperation with business partners (such as customers and suppliers) we process your personal data for the following purposes:

  • Communicating with business partners about products, services, and projects, for example to process inquiries from the business partner;
  • Initiation, execution, and administration of ((pre-) contractual) business relationships as well as maintenance of business relations between Frauscher and its business partner, for example to handle the ordering of products and services, to collect payments, for bookkeeping, billing and collection, and to carry out deliveries, maintenance or repairs;
  • Carrying out customer surveys, marketing campaigns, market analyses, lotteries, competitions or similar actions and events;
  • To maintain and protect the safety and reliability of our products and services and our website, to prevent and detect safety risks, fraudulent activity or other criminal or intentional acts;
  • Comply with legal requirements (such as tax and commercial retention requirements) and group internal policies; and
  • Settlement of litigation, enforcement of existing contracts and assertion, exercise and defense of legal claims.

 

For the above purposes, we may process the following categories of personal information:

  • Professional contact information, such as name, professional contact address, professional telephone number or e-mail address;
  • Payment information, such as information required to process payment transactions or fraud prevention, including credit card information and card verification numbers;
  • Information collected from publicly available sources, information databases or credit bureaus; and
  • Other personal data whose processing is necessary for the initiation, processing, and management of ((pre-) contractual) business relationships and the maintenance of business relationships or which are voluntarily provided by you, such as orders placed, order details, requests made or project details, correspondence or other cooperation data;

 

The processing of personal data is necessary to achieve the above-mentioned purposes, including the performance of a contractual relationship or a pre-contractual activity with the business partner. The legal basis for the processing of this data is point (b) of Article 6(1) GDPR, because this data is needed so that we can fulfill our (pre-) contractual obligations to you.

If the personal data are not provided or not available to the required extent or if we cannot collect these, the individual described purposes may not be fulfilled or the request(s) may not be processed. Please note that this would not be considered a contractual default on our part.

The hosting services we use are for the purpose of providing the following services: infrastructure and platform services, computing capacity, storage and database services, security and technical maintenance services we use to operate this website.

In doing so, we or our hosting service provider processes inventory data, contact data, content data, contract data, usage data, metadata and communication data of customers, prospects and visitors to this website based on our legitimate interests in the efficient and secure provision of our website according to point (f) of Article 6(1) GDPR and Article 28 GDPR.

4.7.1.     More Definitions

Special Categories of Personal Data

Special Categories of Personal Data means Personal Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation.

We do not require any Special Categories of Personal Data from you for the application process.

4.7.2     Controller

Differently to the explanations given under point 3:

The controller (according to point 7 of Article 4 GDPR) of the application tool as well as the applicant management is Frauscher Sensortechnik GmbH and Frauscher Sensor Technology Group GmbH, Gewerbestraße 1, 4774 St. Marienkirchen, Austria.

The controller of your application is the company to which you have applied.

Frauscher Sensortechnik GmbH and Frauscher Sensor Technology GmbH are processors in this respect.

This Privacy Policy gives you information that applies to all data controllers within the European Union.

Inquiries and requests regarding your Personal Data will be processed by Frauscher Sensortechnik GmbH (see point 9).

4.7.3     Purpose of data processing

Differently to the explanations given under point 6:

The purpose of processing your data is to carry out the application process, to select applicants and to manage applicant profiles in our database.

If you do not provide us with your data, we will not be able to process your application.

4.7.4     Lawfulness of processing your data

We process your Personal Data:

  • in order to take steps at the request of the data subject prior to entering into a contract (Art. 6 (1) lit. b GDPR),
  • for the purposes of the legitimate interests (Art. 6 (1) lit. f GDPR),
  • because you have given your consent to the processing (Art. 6 (1) lit. a GDPR) for storage, forwarding to other group companies and newsletter transmission.
     

4.7.5     Data we process

The individual types of data we process can be found in Appendix 1 of this Privacy Policy.

Note - Special Categories of Personal Data

We do not require any Special Categories of Personal Data from you for the application process and we therefore request that you do not provide us with any Special Categories of Personal Data. If the application documents you send us contain Special Categories of Personal Data, you explicitly consent to the processing (storage) of such Special Categories of Personal Data by us. You can revoke this consent at any time and without cause (see point 8).

4.7.6     Applicant profile

When you submit your application via our application tool, you create an applicant profile.

In your applicant profile, you can view and update your data at any time, change your privacy options and delete your profile. In addition through your applicant profile, you have access to the status of applications already submitted and you can withdraw applications.

4.7.7     Newsletter

Hear more about career opportunities:

You have the option to sign up for the "Hear more about career opportunities" newsletter. By clicking the checkbox, you agree to receive the job newsletter at the e-mail address you provided in the applicant profile. You can revoke this consent at any time and without giving reasons. This is possible by deactivating the newsletter subscription in your profile under "Search options and Privacy". We will process your data for the purpose of sending the newsletter until you revoke your consent. The revocation does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

Receive new job posting notifications:

Furthermore, you have the option to receive information about interesting jobs as well as career opportunities by e-mail via a search agent you have set up by clicking the checkbox at "Receive new job posting notifications". You can customise the settings for this search agent yourself in your profile, under Options - Job alerts. If you do not customise the settings in the search agent, your search entries will be used. By clicking the checkbox, you agree to receive new job postings to the e-mail address you specified in the applicant profile. You can revoke this consent at any time and without cause. This is possible by deactivating the registration in your profile under "Options - Job alerts". We will process your data for the purpose of sending you new job notifications until you revoke your consent. The revocation does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

4.7.8    Origin of the processed data

We collect the data listed in Appendix 1 as part of the application process either by you providing it to us (for example, by creating an applicant profile, applying for a position that is open) or by collecting it from you ourselves (for example, by taking notes during the interview).

4.7.9     Transfer of data

Differently to the explanations given under point 5:

In order to achieve the purposes indicated, we will disclose your data to the following recipients (processors). This disclosure may be made by transmission, dissemination or any other form of provision. We have entered into a Data Processing Agreement with the processors, which ensures that your Personal Data is handled in accordance with data protection requirements.

  • Affiliated companies (§§ 15 cont. of the Austrian Stock Corporation Act), if you apply for employment with such a company or your consent has been obtained,
  • IT service providers, such as
    • SAP Österreich GmbH , Lassallestraße 7b, 1021 Vienna, Austria, case-by-case transfer to a third country cannot be ruled out (Data Protection Agreement has been concluded, basis for transfer to a third country is Art. 49 (1) lit. b GDPR)
       

4.7.10     Duration of data storage

Application data for a specific position:

We generally retain your data for the duration of the application process and for seven months after completion of this application process. After this period, your Personal Data will be deleted unless

  • you have not consented to the storage of your data in a record database and/or
  • there are no legal provisions that prevent deletion and/or
  • no other legitimate interests of ours conflict with deletion.
     

Applicant profile data:

We generally retain your data in the application profile for 1 year from the date of your last activity in the profile. After this period has expired, your Personal Data will be deleted,

  • unless the deletion period for the application data has not yet expired and/or
  • unless you have consented to the transfer to a record database and/or
  • unless deletion is prohibited by law and/or
  • provided that no other legitimate interests of ours prevent deletion.
     

4.7.11  Cookies

When you use the application tool, cookies are stored on your terminal device. 4.7.12  Data processing upon conclusion of an employment contract

If we conclude an employment contract with you, the transmitted data will be stored and processed as employee data for the purpose of handling the employment relationship in compliance with the statutory provisions. The whistleblower system can be used anonymously without providing personal data. This means that, when submitting a report, the anonymity of the whistleblower can be fully preserved.

1.1.2 To ensure the security of the data provided by the whistleblower, data transmission takes place exclusively using SSL encryption. We do not use any tracking tools or third-party cookies on the website.

1.1.3 The whistleblower system uses special encryption methods to ensure that only the respective whistleblower and our responsible Compliance Officers have access to the report provided. This means that the data contained in the report is only disclosed to the respective Compliance Officer within our Company; it is not disclosed to third parties in any other way (except for possible disclosure to competent authorities or courts, and/or to auditors for the further pursuit of the facts on which the report is based). In particular, our processors cannot access data within the report.

2. Recipients fo your personal data

2.1  For the above purposes, we may disclose your personal data to the following recipients:

  • For the technical hosting of the whistleblower system: RBS Responsible Business Solutions GmbH based in Vienna (no content data of the report is transmitted, only secondary technical data) as well as the technical sub-contractors A1 Telekom Austria AG and Wolf Rechtsanwälte GmbH & Co KG.
  • Where disclosure is required (i) by law or regulation or (ii) for the establishment, exercise or defence of legal claims, we may also disclose personal data to competent authorities, such as supervisory, regulatory or criminal authorities, courts or other third parties advising us in this regard (e.g. lawyers, forensic experts or auditors).

2.2 Your data will only be processed within the EEA. Therefore, it will not be transferred to a third country.

3. Storage period of your data

3.1 Log files (see point 3.3 above) are generally retained for a period of three (3) months. Beyond this period, log files are only stored to investigate irregularities or security incidents in our systems. For the storage period of cookies, see point 3.5 above.

3.2 In general, we will only retain your personal data for as long as necessary to fulfil the purpose for which it was collected. Once a report has been verified, personal data contained therein will be deleted after the end of the legal retention period, unless investigations lead to disciplinary, legal or regulatory action.

3.3 Secondary technical data (IP address of the access to the whistleblower system) are processed exclusively inside the firewall of the processor and deleted after 24 hours.

5 Transmission and disclosure of data and data transfer

In general, we only use your personal data within the Frauscher Group. The companies belonging to the Frauscher Group can be found on our website: https://www.frauscher.com/en/company/locations-partners.

Within the legal provisions, we may transfer personal data to courts, authorities or law firms or other business partners (such as shipping or logistics partners for the execution and processing of orders).

If and as far as we engage third parties for the execution of contracts (e.g., logistics service providers), personal data will only be provided to that extent which is absolutely necessary for the corresponding service.

In the event that we outsource certain parts of the data processing ("processing on behalf of a controller (processor)", Article 28 GDPR), we contractually obligate the processor to use personal data only in accordance with data protection laws and ensuring the protection of the data subject's rights.

It is possible that recipients are located in countries outside the European Union ("Third Countries"), where the applicable law does not guarantee the same level of data protection as in your home country. In that case, a transmission will only take place if the Third Country has an adequacy decision of the European Commission, or appropriate guarantees have been agreed with the processor (e.g. EU standard contractual clauses have been concluded), the processor participates in an approved certification system (e.g. EU-US Privacy Shield), or binding internal data protection regulations according to Article 47 GDPR or an exemption according to Article 49 GDPR exists.

Any transfer of your personal data to third parties beyond the extent already described will only take place if this is necessary for the processing of your request, for the fulfillment of the contract or, more generally, for fulfilling our obligations or due to mandatory legal/regulatory requirements. For other purposes, your personal data will not be disclosed to third parties.

6 Legal Basis and Storage Periods

Data processing takes place on the legal basis of point (a) of Article 6(1) GDPR (consent) and / or point (b) (contract initiation / performance) and / or point (f) (legitimate interest).

The processed personal data are used for statistical evaluations as well as for the purpose of operation, safety, and optimization of this website (legitimate interest). Any further use of your personal data (e.g., shipping of product and service information) will only take place with your consent.

As far as no explicit storage period is specified when collecting your personal data (e.g. in the context of a declaration of consent), your personal data will be deleted (or anonymized), to the extent they are no longer required and provided that deletion or anonymization does not contradict any statutory storage requirements(e.g. trade and/or tax-related retention obligations), warranty obligation and/or security-related obligation.

7 How we protect your data

All personal data collected by us will be protected by appropriate technical and organizational measures, taking into account the state of the art, implementation costs and the nature, scope, circumstances and purposes of the processing and the likelihood and severity of the risk to individuals' rights and freedoms within the meaning of Article 32 GDPR against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons or misuse. For example, your personal data is stored in a secure operating environment, not open to the public. As a principle your personal data is encrypted during transmission by Secure Socket Layer (SSL) technology. This means that an approved encryption method is used for the communication between your terminal and the Frauscher servers or, if required, to the assigned processor, provided that your browser supports SSL.

Please note that we do not assume any liability for the disclosure of information due to errors in data transmission not caused by us or not attributable to us and / or due to unauthorized access by third parties.

All our employees and all third parties involved in the processing of data are obliged to comply with the applicable data protection rules and corresponding laws and the confidential handling of personal data.

In general, you have the right to information, correction, deletion, restriction, data portability and objection regarding your stored personal data. If the processing of your data takes place on the basis of your consent, you have the right to revoke the consent at any time, though without affecting the legality of the processing carried out on the basis of the consent until the revocation. If you believe that the processing of your personal data violates data protection laws or otherwise your data protection rights have been violated in any way, we ask you to contact us by using the contact details below. If clarification is not possible, you can file a complaint to the supervisory authority. In Austria the data protection authority (“Datenschutzbehörde”) is responsible.

To ensure an efficient response to such concerns, we may always request proof of your identity, such as by submitting an electronic ID card copy.
